Drubner submits new text change application

Attorney Edward G. Fitzpatrick, representing Timex Group, Route 188 LLC and Stacey Drubner, submitted an application for a text change to the Planning and Zoning Commission (P&Z) at its July 6 meeting. The proposed text change is for building height in the LI-80 (light industrial) zone.

Fitzpatrick said the text change would increase building heights in that zone to 44′ from 35′. He said higher buildings are needed to accommodate emerging technology such as robotics. He said he would present evidence and significant reasons in support of the text change at the public hearing on the application.

The Commission set a September 7 date for the public hearing. Public hearings are held at the beginning of P&Z’s monthly 7 p.m. meetings.

Room 26 was full, with all the chairs occupied and a few standing. When P&Z Chairman Terry Smith noted receipt of the application and that the fees had been paid, a member of the audience shouted, “Have the checks cleared?”

The chairman ignored the question, but for those interested in the application process, it requires all fees to have been paid (and the checks cleared). It also requires verification from the tax collector that the applicant’s property taxes are paid. Otherwise, an application cannot move forward. Fees for this application totaled $3,850.

A public hearing on town wide bed and breakfasts was originally scheduled for the July 6 meeting, but that application was withdrawn. Other than the Drubner application, the only other agenda item was approval of the June 1, 2023, meeting minutes, which was done.

At the next P&Z meeting, on August 3, a public hearing will be held on the application from Jennifer Mahr/Middlebury Small Town Alliance for a zoning regulation amendment for a moratorium on distribution facilities of any size and warehouses in excess of 100,000 square feet.
