Conservation Commission approves distribution facility application

The Middlebury Conservation Commission on May 10, 2023, approved Inland Wetlands Application #490 from Drubner Associates for the property at 555 Christian Road and 764 Southford Road (the Timex property). Chairman Paul Bowler and Commissioners Curtis Bosco and George Tzepos voted for approval; Commissioner Peggy Gibbons voted against it. Commissioners Mary Barton, Brian Stroby and Joseph Martino were absent.

After the meeting adjourned, residents in attendance expressed outrage at the decision, calling out, “Shame on you,” and speaking directly to some commissioners, asking them how they could have voted to approve the application. One said, “Thanks for listening to the town.”

The applicant’s attorney, Ned Fitzpatrick, said he believed the Conservation Commission acted properly and prudently in approving the application based on the scientific evidence the applicant provided. Asked if an application would now be made to the Planning and Zoning Commission, Fitzpatrick said he expected that to happen fairly quickly although perhaps not as early as the June P&Z meeting.
