Custody dispute turns into drug arrest

Middlebury Police Chief Fran Dabbo said a custody dispute turned into a drug arrest Sunday night when a father who was late returning his son was arrested on an outstanding threatening warrant.

When Elliott Nieves, 29, of 191 Academy St. in Jersey City, N.J. did not return his four-year-old son at noon on Sunday, March 5, the child’s grandmother became concerned. Nieves was supposed to return the child after taking the boy for ice cream on Saturday. He later called the grandmother to ask if he could keep the child overnight. He promised to return the boy Sunday by noon.

When he had not returned by 4 p.m. Sunday, the grandmother  called police. She stated that she feared for the child’s safety due to Nieves’ criminal history. She also stated that Nieves had outstanding warrants from New York, New Jersey and Connecticut.

Officers Ed Demers and Pat Deely, along with Connecticut State Troopers from Troop A, were waiting when Nieves arrived in Middlebury around 10:30 p.m. Sunday night. They arrested him on an outstanding Middlebury warrant for second-degree threatening.

During the arrest, police discovered Nieves had in his possession seven small bags of crystal meth and two small bags of Molly. Nieves was arrested and charged with possession of a controlled substance and risk of injury to a child. He was held on a $75,000 bond. Authorities in New York and New Jersey are waiting to serve their warrants.
