Middlebury files for Towantic hearing continuation

UPDATED at 10:30 p.m. Jan. 15: Connecticut Siting Council Staff Attorney Melanie Bachman said Middlebury’s motion was denied. She said there will be hearings at least through the end of March, and the Council felt that would provide Middlebury with time it needs to prepare.

Attorney Stephen L. Savarese today filed a motion for the Town of Middlebury with the Connecticut Siting Council asking for a continuation of the public hearing and a 60-day extension. The motion says Middlebury has been unduly burdened and not been able to prepare properly and fully participate in the public hearing today, Jan. 15, 2015, because pertinent information was partially or incompletely released. The Dec. 11, 2014, schedule provided less than a month for Middlebury to select and retain experts and prepare testimony, which the motion says left Middlebury at a significant disadvantage and significantly prejudiced in its ability to present its case.

The Siting Council was expected to consider the motion when its 3 p.m. session began. An update on the Council’s decision will be posted as soon as it is available.
